Today, I submitted my second complaint to the Office of Professional Conduct in Utah with regards to David Okerlund Leavitt’s criminal conduct involving harboring and transporting four Venezuelan nationals. In October 2022, Leavitt stowed four illegal aliens in his cabin at 4825 E Hanna’s Way in Mona, Utah, and those aliens would later be rescued by Juab County Search and Rescue during a snowstorm. These acts were a violation of state and federal law. The transporting or harboring of illegal aliens is a third degree felony under Utah Criminal Code 76-10-2901(2)(c). Under federal law, 8 U.S.C. §1324 (1)(A)(ii)-(iii), Leavitt’s actions qualify as a felony under (B)(ii), which mandates that anyone who violates subparagraph (A)(iv) shall be fined under Title 18, imprisoned not more than five years, or both. This penalty is mandated for each alien in respect to whom such a violation occurs. If Leavitt’s actions were deemed to have caused serious bodily injury or to place in jeopardy the life of any person, the penalty rises to imprisonment of not more than 20 years, or a fine under Title 18, or both.
These acts also constitute a violation of Leavitt’s obligations as an attorney with respect to the Rules of Professional Conduct, specifically Rule 8.4(b) and (c). Attorneys are bound to follow the law in their personal lives, and David Leavitt has repeatedly violated the law with respect to the adoption of Allisandra Florence Fishinghawk, as well as his conduct with respect to the four Venezuelan illegals he stowed in his cabin at 4825 E Hanna’s Way in Mona, Utah.
