Nathan Evershed appearing for the State, saying he opposes pretrial modifications to Hamblin's release. He requests a preliminary hearing, Aston says that the defense has requested significant discovery that was ordered by the court, but which was not turned over to the defense as yet. She requests that Evershed makes that a priority. She says a modification should occur, he should be allowed to go to the grocery store. David Hamblin does not look like he's starving.

Nathan Evershed says the material change in circumstances has been resolved with his appointment, and that the State opposes the modification in release conditions on the grounds that nothing has changed with regards to Hamblin being a threat to Emily Sheets, his victim. He says that he can rub his head and pat his belly at the same time with regards to the discovery and the pretrial hearing, he's willing to take an order from the court to resolve the discovery issues within 30 to 45 days. Judge Griffin maintains the release conditions, Hamblin is stuck at home with no underage visitors and no peyote. Suck a potato, pervert.

Judge Griffin says he has concerns that the prosecutors and investigators were slow walking discovery with regards to exculpatory evidence, he understands that Evershed will be able to get up to speed and resolve that. Points out that the Attorney General's Office has been on the case for two years, so he's not persuaded that the AG's Office has been diligent in the case. The only reason Evershed is here is because the AG's Office ordered the AG's office to be there. He is ordering a preliminary hearing in 30 days.

October 2, 2024 works for Evershed. Leah Aston says that works for her, 8:30 a.m., will it be Webex or in person? She requests in person preliminary hearing, Evershed agrees. Griffin will have another hearing in 30 days with regards to discovery. References the thick binder. We love it thick at IRA.

September 27th, 2024 is the date Judge Griffin proposes, Evershed has an in person custody case in SLC that day. Judge Griffin looking at other dates.

July 2, 2024 Webex on discovery hearing. Evershed asks for July 9 at 10:30. It's via Webex. Griffin says he wants to move the case forward. Aston says they will be filing a motion to change venue based on Evershed's appearance. Griffin wants a briefing. Griffin says to spend a little extra time on the brief to Aston.

Would you explain that the AG's office ordered the AG's office to be there. That doesn't make sense to me. How does an office order itself? What motivated the AG's office to send a prosecutor.

She's requesting that the terms of pretrial release be lessened and the discovery be turned over. Judge Griffin references statement by lead investigator that UCSO had hoped to get through the pretrial hearing stage before turning over exculpatory evidence.

Heidi Nestel raising the fact that Hamblin proposed home confinement as a condition to get out of custody in the Utah County Jail. It was his idea. She's saying the hurdles have been overcome, we have a prosecutor, we should take Hamblin at his word that he was willing to undergo home confinement to get out of jail. She asks the court to deny the modification.

From everything that I have read about Nathan Evershed he sounds like a good choice. Hopefully he can get justice for the victims and perhaps even expose the culture that has lead to the pernicious cover-up of the crimes committed by Hamblin et al.
