September 18 at 1 p.m. is the next status hearing. Roselle has no restrictions lifted, and there is no recusal. Suck a potato, Satan.

Cara Tangaro filed a motion to recuse, the State replied, now is asking State if they want oral argument. State via Michael Starrs is asking for an oral argument, he wants to supplement his response based on the Manti hearing on July 31st, Tangaro says the Manti case doesn't involve Rosie, judge asks if the issues are similar...Tangaro says no. The cases are distinct.

Tangaro argues that under the law and under the facts, Rosie is a codefendant in the American Fork case, and the interlocutory appeal ruling by the Court of Appeals makes the issue of motion to recuse ripe. She wants a ruling today.

Judge asks if they want an evidentiary hearing, if I don't wait for the Hamblin case in the Manti case. He can rule based on the briefs submitted in this case, or they can have oral arguments on the briefs. Starrs says he wants to supplement his response regardless of whether or not they get the oral argument. The judge says he'd have to grant the motion for supplemental brief, says that he thinks they need as much information as possible, he doesn't want to drag it out forever. Set a cutoff...the hearing is on the 31st, there will be a transcript. Starrs says he can get audio quicker. The judge says he wants the supplemental brief no later than two weeks after July 31st. August 14th. Tangaro can supplement her brief by 28th of August.

Starrs notes that he will be in Dallas for a conference from August 11 to the 15 for SVU prosecution. He wants to do one week after. August 21 for a brief due date. Tangaro due 14 days after on September 4, 2024. They will need to request oral arguments after the 4th, otherwise they'll set a notice to submit to trigger a ruling.

Starrs says that they can do that. Tangaro is talking about filing a motion to lift the restrictions on Stevenson, updating the court on what she's been doing. The judge says he gets a report from AP&P about her release, and says it's been glowing in terms of Roselle's compliance. Ford has to go with her to swim five times a week, they want to lift. Starrs says he's not prepared to address that, she'll need to file a motion.

Court date after September 3, two or three weeks, 18th of September status hearing at 1 p.m.

Cara Tangaro is arguing that Roselle is a codefendant in the American Fork, she says that the interlocutory appeal was denied. Tangaro notes Nathan Evershed is now special prosecutor, she says she spoke to him, he has not been asked to take the Stevenson case. She wants motion to recuse granted, then to come back for a status hearing to see if another prosecutor will take it, if not, then motion to dismiss for failure to prosecute. The judge is looking at his docket.

Status hearing. They're talking about the Hamblin case in American Fork, and UCAO has requested an evidentiary hearing on the motion to recuse UCAO from the Stevenson case. UCAO wants to wait until after the Manti evidentiary hearing on July 31st to go forward with a supplemental brief. Defense counsel disagrees.

I also could see lots of room in the court for people to fill it up and wear T-shirts sayings "Justice Now" The judge needs to know that there are people who take this seriously.
