Jeff Gray did not even send anyone to the hearing today. That is unacceptable. In 30 days time, barring another county attorney taking up the case and entering an appearance, the Hamblin case is likely to be dismissed for failure to prosecute. Emily Sheets, the victim, who courageously came forward with two eyewitnesses to her abuse, will be denied her day in court after nearly two years of shenanigans by the prosecution, the defense, and the political establishment of the State of Utah which includes Governor Spencer Cox.

So awful! I believe Cox and these judges are protecting Hamblin and others☹️. I believe Joe Bennion is friends with our rhino governor

Chad Perkins says that it a case for the Attorney General, based on the fact that it originated with the Attorney General in the appointment of Ryan Peters as Special Prosecutor. Chad Perkins says it reverts back to the Attorney General's Office, and that UCAO has previously notified the Attorney General's Office. The Attorney General may not have had notice of the hearing today, which explains why they weren't in attendance.

Judge Griffin says the prosecutor, which is the AG, has time to respond to her written motion on the pretrial release conditions. 8:15 next Thursday morning, there will be a hearing. Notice will be sent to the Attorney General's Office, as well as the attorney involved in the expungement hearing. It may not hurt for Leah Aston to reach out as well, Judge Griffin says. Craig Barlow was apparently noticed as to the hearing via email, Aston claims. If the Attorney General's Office does not show, that will add a new complexity according to Judge Griffin.

Leah Aston continues to advocate for the lifting of pretrial release conditions, as well as the continued lack of prosecution as a basis for dismissing the case.

In essence, the State has effectively thrown the game with an assist from the Court of Appeals and Governor Cox. The State has represented that it cannot find another prosecuting agency. Leah Aston was supposed to start her trial 20 minutes ago, and Judge Griffin is asking if she can come back at noon, she rebuts with 12:30 p.m. Judge Griffin says to be back at 12:30. The judge instructs Perkins to contact Chad Grunander, and possibly appear at 12:30. Perkins can't oppose the motions, but he can indicate that another county attorney is entering an appearance or if the State Attorney General's Office is taking over. If that doesn't happen, then in 30 days, the judge will dismiss the case for failure to prosecute as there is no prosecutor.

The professionalism is breathtaking. Judge Griffin is now requesting Jared Perkins reach out to Deputy County Attorney Chad Grunander to find out what the next step is, which is unbelievable. Leah Aston is now seizing the opportunity to argue for the lifting of David Lee Hamblin's pretrial release conditions today, as well as dismissal for failure to prosecute. The State has time to address the motion for pretrial release conditions. Judge Griffin says he is unsure of what to do. There is no one for Leah Aston to communicate with, there is no prosecuting agency on the case, the court has the authority to dismiss the case today.

The Court of Appeals upheld the order disqualifying Utah County Attorneys Office, Jeff Gray withdrew his permission to continue the hearing, and there is no one from the State at the hearing. Jared Perkins UCAO, says he understands that the Court of Appeals upheld the ruling excluding UCAO, but no one knows what the next step is, or who will be prosecuting the case.

Since Aston was not ready with Hamblin, we are now wading through the detritus of the Utah County Jail, where David Hamblin belongs, but he got a pretrial supervised release which he is now requesting be lifted. Again, the sands of time fall in the hourglass of the unjust and the useless.

He also nominated the judge in Sanpete 2 months before Hamblins hearing as well! I think there’s other reasons for Spencer Cox’s interference
